Maryland Sand Gravel & Stone, et al. and U.S. v. Moyers, et al.
Superior Accomplishment Recognition Award and Special Act Award, EPA, Region IX, September 2001: Award presented by the Office of Regional Counsel for simultaneously negotiating an agreement with over 70 potentially responsible parties regarding the Casmalia Disposal Site, as well as settlement with the State of California relating to its liability at the Casmalia Disposal Site, and for pursuing a global settlement negotiations with the 54 largest generators to the Casmalia Disposal Site.
Regional Superfund Team of the Year, EPA, Region IX, May 15, 2001: Award presented to the Legal and Technical EPA personnel assigned to the Purity Oil Superfund Site for developing a creative approach leading to the relocation of local residents and the initiation of the cleanup of the Site.
Superior Accomplishment Recognition Award, EPA, Region IX, October 2000: Award presented by the Office of Regional Counsel for negotiating a consent decree with over 100 potentially responsible parties regarding the Omega Chemical Corporation Superfund Site.
Special Act Award, EPA, Region IX, October 2000: Award presented by the Underground Storage Tank Program for assistance during the year related to the Tuba City Site, including the preparation of Administrative Orders and negotiating the implementation of a pilot study Subsurface Vapor Volatization System (“SVVS”) at the Site.
Special Act Award, EPA, Region IX, October 1998: Award presented by the Emergency Response Office for overall assistance during the year in the preparation of Unilateral Administrative Orders, Information Requests, and general enforcement of CERCLA in the removal action context.
Outstanding Performance Award, EPA, Region IX, September 1998, December 1997, and December 1996: Award presented by the Office of Regional Counsel for continued legal support provided to the Superfund Emergency Response Office, and overall yearly performance as an Assistant Regional Counsel, including the development, evaluation, and preparation of litigation referrals to the U.S. Department of Justice pursuant to RCRA, the Clean Air Act, and the Clean Water Act during the course of the year.
Special Act Award, EPA, Region IX, January 1997: Award presented by the Office of Regional Counsel for assistance provided to the Department of Justice in the successful prosecution of a CERCLA section 104(e)(5) penalty action in U.S. v. Omega Chemical Corporation, et al., which resulted in receipt of the largest per day and total penalty ever awarded in a CERCLA section 104(e) action based on a property owner’s denial of access.
Regional Notable Achievement Award, Regional Superfund Team of the Year, EPA, Region IX, December 1995: Award presented by the OSC/RPM/SAM Support Program for support provided to the Superfund Emergency Response Office relating to the Central Eureka Mine site.
Outstanding Performance Award, EPA, Office of Enforcement, July 1994, October 1993, December 1992, and October 1991: Award Presented by Division Director for Superfund for overall performance in the Superfund Enforcement Division, in particular policy work related to trustee liability under CERCLA, U.S. v. Moyers et al. and, U.S. v. Maryland Sand Gravel & Stone, et al.
